Acceptance of Terms

By downloading, installing, or using the Paal Pannai mobile and web application (the "App") operated by XQ Tech Solutions ("we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Paal Pannai is a livestock management application that provides the following services:

  • Animal record management (registration, lifecycle tracking, identification)
  • Milk production tracking and reporting
  • Health management (vaccination schedules, deworming, veterinary records)
  • Breeding and reproduction management (AI tracking, heat cycles, calving)
  • Feed and nutrition management and calculations
  • Financial tracking (milk sales, expenses, profit/loss reports)
  • Task reminders and notifications
  • Data export in Excel and PDF formats

User Accounts

Registration

  • You must create an account to use the App
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 13 years of age to create an account

Account Responsibility

  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

Acceptable Use

You agree to use the App only for lawful purposes. You shall not:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality or servers
  • Upload malicious code, viruses, or harmful data
  • Use the App to harass, abuse, or harm others
  • Reproduce, duplicate, or resell any part of the App without permission
  • Use automated tools to scrape or extract data from the App

User Data and Content

Ownership

You retain ownership of all data you enter into the App, including animal records, milk production data, health records, financial data, and any uploaded images.

License

By using the App, you grant us a limited license to store, process, and display your data solely for the purpose of providing the App's services to you.

Data Accuracy

You are responsible for the accuracy of data you enter. We are not liable for any decisions made based on inaccurate data entered into the App.

Intellectual Property

  • The App, including its design, code, features, logos, and content, is the intellectual property of XQ Tech Solutions
  • You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business livestock management purposes
  • You may not copy, modify, distribute, or create derivative works based on the App

Service Availability

Uptime

We strive to maintain the App's availability but do not guarantee uninterrupted service. The App may be temporarily unavailable due to:

  • Scheduled maintenance and updates
  • Technical issues or server outages
  • Force majeure events beyond our control

Offline Access

Certain features of the App are available offline through local data caching. However, full functionality requires an internet connection for data synchronization.

Fees and Payment

  • The App may offer free and paid features or subscription plans
  • Pricing and subscription terms will be clearly communicated within the App
  • We reserve the right to modify pricing with prior notice to users
  • Refunds, if applicable, will be processed according to the platform's refund policies (Google Play Store / Apple App Store)

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Accuracy or reliability of livestock management calculations
  • Uninterrupted or error-free operation
  • Compatibility with all devices or operating systems

Important: The App provides tools for livestock management but does not replace professional veterinary advice. Always consult a qualified veterinarian for animal health decisions.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • XQ Tech Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid by you for the App's services in the 12 months preceding the claim
  • We are not liable for any loss of data, profits, or business opportunities arising from the use of the App
  • We are not responsible for decisions made based on data or calculations provided by the App

Indemnification

You agree to indemnify and hold harmless XQ Tech Solutions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

Termination

  • You may stop using the App and request account deletion at any time
  • We may suspend or terminate your access if you violate these Terms
  • Upon termination, your right to use the App ceases immediately
  • We will handle your data in accordance with our Privacy Policy upon account deletion

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be communicated by:

  • Posting updated Terms within the App
  • Updating the "Last Updated" date
  • Notifying users via email for significant changes

Continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law and Disputes

  • These Terms are governed by the laws of India
  • Any disputes shall be subject to the exclusive jurisdiction of the courts in Palakkad, Kerala, India
  • Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
