Terms & Conditions - Field Fresh Milk
Acceptance of Terms
By downloading, installing, or using the Field Fresh Milk mobile application (the "App") operated by XQ Tech Solutions ("we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App.
These Terms apply to all users of the App, including customers subscribing to milk and dairy deliveries and local vendors managing delivery operations.
Description of Service
Field Fresh Milk is a dairy delivery and management application providing the following:
For Customers
- Subscribe to daily, weekly, or monthly milk and dairy deliveries
- Manage subscriptions, holiday pause, and quantity changes
- Receive delivery notifications and reminders
- View delivery history and payment summaries
For Local Vendors
- Onboard customers and manage subscriptions
- Plan and track daily delivery routes
- Record deliveries and reconcile payments
- Generate billing summaries for customers
User Accounts
Registration
- You must create an account to use the App
- You must provide accurate and complete information
- You are responsible for keeping your account credentials secure
- You must be at least 13 years old, or have parental consent if 13–17
- Vendors must provide valid business and contact information
Account Responsibility
- You are responsible for all activity under your account
- Notify us immediately of any unauthorized access
- We may suspend or terminate accounts that violate these Terms
Subscriptions, Pricing, and Payment
Subscriptions
- Customers may subscribe to daily, weekly, or monthly milk and dairy deliveries
- Subscription pricing is set by individual vendors and may vary by location and product
- You may pause, modify, or cancel subscriptions through the App, subject to vendor terms
Pricing
- All prices are in Indian Rupees (INR) and include applicable taxes
- Vendors may revise prices with prior notice through the App
Payment
- Payments may be collected daily, weekly, or monthly depending on the vendor's policy
- Payment methods accepted are determined by individual vendors (cash, UPI, online)
- Field Fresh Milk facilitates billing summaries but is not a payment processor
Delivery
- Delivery times are determined by vendors based on their daily route
- Delivery may be delayed due to weather, traffic, or holidays
- Customers must ensure delivery location is accessible
- Quality complaints (spoiled or wrong product) must be raised within 24 hours
Acceptable Use
You agree not to:
- Use the App for illegal or unauthorized purposes
- Place fraudulent subscriptions
- Harass or abuse vendors, delivery personnel, or other users
- Attempt to gain unauthorized access to the App
- Interfere with App functionality (scraping, bots, denial of service)
- Upload malicious code or harmful data
Vendor Responsibilities
- Vendors are independent local milk suppliers and not employees of XQ Tech Solutions
- Vendors are responsible for product quality, freshness, and safe delivery
- Vendors must comply with applicable food safety and licensing laws (FSSAI, etc.)
- XQ Tech Solutions provides the platform but does not guarantee vendor performance
Intellectual Property
- The App, its design, code, and logos are the intellectual property of XQ Tech Solutions
- You are granted a limited, non-exclusive, non-transferable license to use the App
- You may not copy, modify, distribute, or create derivative works
Service Availability
- We strive to maintain App availability but do not guarantee uninterrupted service
- The App may be unavailable for maintenance or due to technical issues
- We are not liable for losses arising from temporary service interruptions
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, including:
- Quality, freshness, or suitability of milk and dairy products supplied by vendors
- Accuracy of delivery times or pricing
- Uninterrupted, error-free service
Limitation of Liability
To the maximum extent permitted by law:
- XQ Tech Solutions shall not be liable for indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount paid by the customer for the specific subscription in question, or INR 1,000, whichever is higher
- We are not liable for vendor performance, product quality, or delivery delays beyond reasonable mediation
Indemnification
You agree to indemnify and hold harmless XQ Tech Solutions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights
Termination
- You may stop using the App and request account deletion at any time
- We may suspend or terminate access if you violate these Terms
- Upon termination, your right to use the App ceases immediately
- Data will be handled per our Privacy Policy
Changes to Terms
We may modify these Terms at any time. Changes will be communicated by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Notifying users of significant changes via email or in-app notification
Continued use of the App after changes constitutes acceptance.
Governing Law and Disputes
- These Terms are governed by the laws of India
- Disputes shall be subject to the exclusive jurisdiction of the courts in Palakkad, Kerala, India
- Parties agree to attempt good-faith negotiation before initiating legal proceedings
Severability
If any provision of these Terms is found unenforceable, that provision shall be limited to the minimum extent necessary, and the remaining provisions shall remain in full force.
